Information We Collect

To use the Platform, you must meet the following requirements:

• You must be at least 18 years of age with a high school diploma.
• You must have the legal capacity to enter into a binding agreement.
• If you are using the Platform on behalf of an employer, you must have the authority to bind that employer to these Terms & Conditions.
• Your use of the Platform must comply with all applicable laws and regulations in your jurisdiction.

Account Registration & Security

To access certain features of the Platform, you must create an account. When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information and updating it as necessary.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other security breach.

You may not share your account credentials with others, and you may not use another person's account without their permission. We reserve the right to suspend or terminate accounts that violate these Terms & Conditions.

Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms & Conditions. You agree NOT to:

• Violate any applicable law, regulation, or third-party rights.
• Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, discriminatory, or otherwise objectionable.
• Misrepresent your identity, qualifications, employment history, or affiliation with any person or organization.
• Post opportunities that are fraudulent, misleading, discriminatory, or otherwise unlawful.
• Scrape, harvest, or collect information from the Platform using automated means without our prior written consent.
• Attempt to gain unauthorized access to the Platform, user accounts, or computer systems or networks.
• Interfere with or disrupt the integrity or performance of the Platform.
• Upload viruses, malware, or any code designed to disrupt, damage, or limit the functionality of the Platform.
• Use the Platform to spam, solicit, or send unsolicited communications.
• Circumvent or disable any security features or access controls of the Platform.

User Content

The Platform allows you to submit, upload, and share content, including but not limited to profiles, resumes, cover letters, messages, and other materials (collectively, "User Content"). You retain all ownership rights to your User Content.

By submitting User Content to the Platform, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and providing the Platform and our services.

You represent and warrant that: (a) you own or have the necessary rights to submit your User Content; (b) your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights; and (c) your User Content complies with these Terms & Conditions and all applicable laws.

You are solely responsible for your User Content and the consequences of posting or publishing it. We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any User Content.

We reserve the right, but have no obligation, to monitor, review, or remove User Content that violates these Terms & Conditions or is otherwise objectionable, without prior notice to you.

Applications to Postings & Platform Role

The Platform serves as an intermediary that facilitates connections between youth and employers seeking to hire for paid or unpaid opportunities. We are not an employer, recruiter, or employment agency. We are not the agent of any person using this Platform.

We do not make hiring decisions, guarantee placements, interviews, or employment outcomes. All hiring decisions are made solely by the organizations posting opportunities.

When you submit an application to a posting through the Platform, your profile, resume, and application materials will be shared with the relevant organization. We are not responsible for how organizations use, store, or handle your information.

We do not guarantee the accuracy, legality, or quality of job postings. Individuals accessing the Platform should exercise their own judgment and due diligence when applying for positions.

Employer Responsibilities

If you are using the Platform as an employer to post opportunities, you agree to the following additional terms:

• All postings must be accurate, truthful, and for legitimate work-based learning or employment opportunities.
• Postings must comply with all applicable employment, anti-discrimination, and labour laws.
• You will not post opportunities that require illegal activities or discriminate based on protected characteristics.
• You are solely responsible for your hiring decisions and employment practices.
• You will handle candidate information in accordance with applicable privacy and data protection laws.
• You will not use the Platform to collect candidate information for purposes unrelated to hiring.

Communications

By using the Platform, you consent to receive communications from us, including email notifications, in-app messages, and other electronic communications related to your account and use of the Platform.

You can manage your notification preferences in your account settings. However, you cannot opt out of certain transactional or administrative communications, such as account verification, security alerts, and legal notices.

The Platform includes messaging features that allow youth and employers to communicate. You agree to use these features professionally and in accordance with these Terms & Conditions.

Intellectual Property

The Platform, including all software, designs, text, graphics, logos, icons, images, audio clips, video clips, data compilations, and other content (excluding User Content), is owned by us or our licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Subject to your compliance with these Terms & Conditions, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform for your personal or internal business purposes.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works of the Platform or any portion thereof without our prior written consent.

Our trademarks, service marks, and logos may not be used without our prior written permission.

Third-Party Services

The Platform may integrate with or contain links to third-party websites, applications, or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party services.

Your use of third-party services is at your own risk and subject to the terms and conditions of those services. We encourage you to review the terms and privacy policies of any third-party services you use.

We do not endorse or make any representations about third-party services, and we are not liable for any damage or loss caused by your use of such services.

Termination

You may terminate your account at any time by following the account deletion process in your account settings. Upon termination, your access to the Platform will cease, and we will delete or anonymize your personal information in accordance with our Privacy Policy and except as required by our data retention policies.

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without cause or notice, if we believe you have violated these Terms & Conditions, engaged in fraudulent or illegal activity, or for any other reason at our sole discretion.

Upon termination by us, your right to use the Platform will immediately cease. We may also remove or delete your User Content, subject to applicable law and our Privacy Policy.

The following titled provisions will survive termination: User Content, Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, and Governing Law and Dispute Resolution.

Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, INFORMATION, OR SERVICES AVAILABLE THROUGH THE PLATFORM.

WE MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT POSTINGS, YOUTH, APPLICANTS, ORGANIZATIONS, OR ANY USER CONTENT. YOUR USE OF THE PLATFORM AND RELIANCE ON ANY CONTENT IS AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DAMAGES; DIRECT INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS & CONDITIONS OF THE PLATFORM, IF THIS ABSOLUTE RESTRICTION OF LIABILITY IS UNENFORCEABLE, SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms & Conditions; (d) your violation of any rights of another party; or (e) your violation of any applicable law or regulation.

Governing Law & Dispute Resolution

These Terms & Conditions and any disputes arising out of or relating to the Platform shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or the Platform shall be resolved exclusively by binding arbitration conducted in Calgary, Alberta, in accordance with the applicable arbitration rules, and the parties hereby consent to the jurisdiction and authority of the arbitrator. You agree to waive any right to a jury trial in any proceeding arising out of or relating to these Terms or the Platform.

Changes to These Terms

We reserve the right to modify or update these Terms & Conditions at any time. If we make material changes, we will notify you by email or through a prominent notice on the Platform before the changes take effect. Your continued use of the Platform after the effective date of the updated Terms & Conditions constitutes your acceptance of the changes. If you do not agree to the updated Terms & Conditions, you must stop using the Platform and may delete your account. We encourage you to review these Terms & Conditions periodically to stay informed about your rights and responsibilities.

General Provisions

These Terms & Conditions constitute the entire agreement between you and us regarding the Platform and supersede any prior agreements. If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms & Conditions will not be deemed a waiver of such provision or our right to enforce it. You may not assign or transfer these Terms & Conditions or your rights under these Terms & Conditions without our prior written consent. We may assign these Terms & Conditions without restriction.

These Terms & Conditions do not create any partnership, joint venture, employment, or agency relationship between you and us.
